R v S(KG), 2009 NUCJ 21

K.G.S. and J.P. (16 and 15 years-old respectively) along with S (not charged) were charged with injuring a dog (puppy). The three youths were walking drunkenly down the street when the puppy approached them. Two young adult eyewitnesses testifies that they saw K.G.S. and J.P. repeatedly stomp the puppy, breaking their hind legs. They called the police and the youths were arrested. A by-law officer came to the house to view the dog, who was euthanized. J.P. testified that when the puppy ran toward them, K.G.S. accidentally stepped on the dog, and that the injuries were not intentional. Testimony from all witnesses was questionable, as it was dark so the owners may not have seen exactly what happened, and J.P. was drunk and may not recall specific details.

Overall, there was doubt with how the puppy was injured, and the two accused were acquitted.
