R v Mennel, 1983 Northwest Territories

Mennel had found an ox laying on ice, which had frozen over the ox’s knees, rendering them immobile. Mennel killed the ox by a blow to the head.

Case turned on meaning of “malice” in old section; judge decided the actions were not malicious. Section cited is from previous version of the Criminal Code.

Mennel was acquitted, as the Judge considered actions to be an act of mercy.
