Mangels had been accused of failing to provide adequate food, water, and shelter for his cattle. The trial judge quashed the information, finding it to be duplicitous. The Crown appealed the quashing. The appellate judge set aside the quashing, allowing the Crowns appeal. The information was not duplicitous, as the Criminal Code offence merely gives multiple ways to commit the offence.
