R v Kokatt, 1944 WWR 158 (SKSC)

Kokatt and Jensen are neighbouring farmers. Jensen’s dog Sport entered Kokatt’s property. Kokatt keeps female breeding dogs and wanted his neighbours to tie up their dogs when the females were in heat. Kokatt believed that he had a right to maim or kill any dog that came onto his property, as they could be a threat to his sheep. When Sport came onto Kokatt’s property, Kokatt neutered Sport with no assistance and no anesthetic. The judge found that a male dog that trespasses because of female dogs in heat does not do so as a threat to any sheep. Therefore, the maiming was not lawfully justified.
